Terms of Service
- These general terms and conditions apply to the use of the website arisha-service.de made available by ARISHA SERVICE (hereinafter Arisha), Pastor-Niemöller-Platz-2 / HH, 13156 Berlin, to search for entrepreneurs for household services and cleaning activities in private households and commercial facilities (hereinafter referred to as "service partner") and for the placing of orders for such services (hereinafter services) by the customer (hereinafter referred to as customer) and the use of Arisha's mediation services. Arisha handles the contract between the customer and the service partner. Deviations from these general terms and conditions require the express consent of Arisha.
- All payments from customers to the service staff for the remuneration of the services are made via a licensed payment service provider (hereinafter referred to as payment service provider) on the basis of a separate payment service contract between the payment service provider and the service staff. Arisha mediates this payment service contract, but is not itself involved in the payment processing process and is not itself a party to the payment service contract.
- Arisha is not responsible for the implementation of the contract between customer and service partner.
- Arisha is committed to:
- To operate the mediation platform and to establish contact with the service partner in accordance with the booking request.
- To create a user account for the service partner and to make all contracts and invoices available there
- To insure the service partners from a damage amount of 200.00 EUR up to 2,000,000 EUR with a liability insurance
- Arisha is not liable for the implementation of the service contract by the service partner and for any damage suffered by the customer in the course of the services. In addition, Arisha is liable in the event of a breach of contractual and non-contractual obligations by Arisha according to the statutory provisions. Arisha is liable for damages - for whatever legal reason - in the event of willful intent and gross negligence. In the event of less than gross negligence, Arisha is only liable (1) for damage resulting from injury to life, limb or health and (2) for damage resulting from the breach of an essential contractual obligation (obligation, the fulfillment of which enables the proper execution of the user contract in the first place compliance with which the CUSTOMER regularly trusts and may rely on (main contractual obligation).
- The pages of www.arisha-service.de also contain links to websites that are maintained by third parties and whose content Arisha may not be aware of. Links to third-party websites are only used to facilitate navigation. Arisha assumes no responsibility for the content of external websites.
- Arisha takes care of changes and cancellations of bookings and forwards them to the service partner immediately.
- The agency contract begins after registration on the platform. The contract is concluded for an indefinite period of time, but can be terminated within the statutory deadlines. Notice of termination must be given in writing. The written termination is accepted by email.
- Information on data protection can be viewed at any time at www.arisha-service.de. Arisha is not responsible for the content of websites that may be linked to on the platform.
Conditions for service partners
- Arisha is commissioned by the service partner to enforce the service contracts and is used as a representative. Arisha receives a commission from the service partner for this.
- By registering on the platform, the service partner agrees to the following agreement.
- The service partner must provide all necessary information truthfully and completely. The following data is requested by Arisha from the service staff:
- Name, address and other personal information
- Available times and places to offer the service
- Copy of identity card / passport
- Tax number
- work permit
- Criminal record certificate
- Email and phone number
- Tax number
- Bank details
- The service partner agrees that Arisha will pass on the necessary payment information to the payment service provider.
- Arisha accepts the booking request from the customer and processes it according to availability. Arisha Service forwards the request to a suitable service partner. If the customer chooses a specific service employee, the request is only forwarded to this service employee. As soon as a service staff agrees to the request, the request is blocked for all other service staff.
- Arisha issues the invoice to the customer on behalf of the service partner. Arisha must be informed immediately if the service partner changes any tax information.
As soon as the customer's booking request has been confirmed by the service partner, the customer will receive the relevant information from the service partner as well as a booking confirmation by email. Arisha acts as an intermediary between customer and service partner. The service partner carries out the service on his own responsibility and according to his own organization.
- Arisha must be informed about possible damage to the client by the service partner
- Arisha is allowed to obtain assessments about the service partner from customers.
- By registering, the service partner agrees to perform the service within the framework of the statutory commercial regulations. Arisha can terminate the contract with the service partner within 4 weeks after the first commissioning if no valid work and trade permit is presented. The service partner is responsible for the proper taxation and duties.
- The service partner can entrust Arisha with accepting booking inquiries on his behalf within the specified available times.
- The service partner is obliged to pay Arisha an amount of up to EUR 200.00 in the event of damage to the customer if the insurance for the service partner applies. The service partner must provide Arisha with all the information necessary in this regard to process the claim.
- The service partner informs Arisha of changes at short notice when executing the order, e.g. delays. Arisha will notify the customer of the changes.
- If the service partner uses employees to carry out the order, Arisha must be informed immediately. The following information about the third person must be provided:
- Name and first name of the person
- Contract between service partner and third party
- Copy of identity card
- Criminal record certificate
- The service partner is also obliged to provide further necessary information.
- The service partner cannot cancel an accepted booking request on the platform. This can only be done by informing Arisha by email or phone. If this is done less than 24 hours before the order is carried out, a flat fee of EUR 10.00 is payable to Arisha. In addition, there are additional costs that Arisha incurs as a result. In the event of illness, Arisha pays the costs. In this case, Arisha must be contacted as soon as possible.
- If a booking request accepted by the service partner has not been carried out by the service partner and the customer does not pay, Arisha's claim to the order continues. The same is if the customer does not pay due to poor performance. The service partner is responsible for enforcing payment claims.
- The duration, time and location of a confirmed booking can be changed at any time with the consent of the customer.
- Arisha sends the customer an invoice for the service partner's service via email and also makes the invoice available on the platform. The payment service provider keeps the invoice amount paid by the customer for the service partner in the Arisha account. The payment service provider pays this amount minus Arisha's commission to the service partner.
- The payment is made for services from the 1st to the 15th of a month no later than the 28th of the month. The payment for services from the 16th to the end of the month will be paid no later than the 9th of the following month.
- If the service partner would like to offer a further service to a customer who has been an Arisha customer within the last 6 months, the service partner is obliged to inform the customer that a booking must be made through Arisha. If the service partner offers an Arisha customer services outside of the platform, the service partner must pay a compensation of EUR 500 plus VAT.
- Arisha can stop forwarding orders to the service partner if the service partner has not accepted any orders for more than a month.
- The service partner agrees that Arisha may contact him by email, phone or post in order to improve the offer you rate.
- Arisha and the service partner treat the customer's data as strictly confidential and are not authorized to pass them on to third parties.
Conditions for customers
- The customer receives a binding booking confirmation by email or SMS as soon as the service partner has agreed.
- Arisha is not responsible for the service partner's performance.
- The prices listed on the website apply.
- Appointment cancellations: All appointment cancellations must be made via Arisha by email or telephone. An appointment that has not been confirmed by the service partner can be canceled at any time free of charge. Confirmed appointments can be canceled free of charge up to 24 hours before the appointment. If the appointment is canceled less than 24 hours in advance, one hour will be charged.
- Changes to dates are free of charge if the service partner agrees.
- Cost plans in which the minimum number of appointments has not been booked must pay the one-time cleaning price for all appointments.
